SUMMARY
The position is responsible for providing expert legal advice and advocacy in the prosecution and hearing of complex cases under the relevant legislation of the various financial sectors of BCFSA, the conduct of appeals to the Financial Services Tribunal (FST), and the conduct of judicial reviews to the BC Supreme Court, as applicable.
ACCOUNTABILITIES

Conducts legal research, prepares legal memoranda with recommendations for case file disposition, and provides expert legal advice on complex and/or sensitive legal matters.

Identifies contraventions of RESA, MBA, FIA, and REDMA, and the respective Regulations and Rules, and drafts formal charges, prepares Notices of Hearing, agreed statements of facts, consent order proposals, and letters of advisement.

Interviews and prepares witnesses, organizes evidence, books of documents, and case authorities.

Conducts considerable legal analysis and evaluation to prepare written legal submissions for proceedings and communications on matters of significant legal importance.

Assesses and recommend penalties based on facts of the case, all relevant precedents and sanctioning principles.

Represents BCFSA at hearings, pre-hearing conferences, and settlement conferences, and prepares case file summaries for publication.

Participates in appeals to the Financial Services Tribunal and applications for judicial review or other civil claims brought before the Supreme Court or the Provincial Court.

Participates in the management of files referred from the Audit department relating to late financial report filings and/or other related conduct infractions.

Participates in the development of policy and procedural solutions to organizational and regulatory challenges consistent with BCFSA’s culture, establishing credibility within the organization, with licensees, the real estate industry, and the public.

Contributes to the team’s development of internal work practices (e.g., policies, procedures, and tools).

Provides orientation and training to internal and/or external stakeholders within area of responsibility.

Contributes to, participates in, and supports organizational business transformation initiatives.
JOB REQUIREMENTS

Thorough knowledge of regulatory and administrative laws and regulations.

Demonstrated negotiation skills.

Strong analytical and legal research skills.

Strong written and verbal communications skills.

Excellent judgement and analytical skills.
EDUCATION
-
Law Degree, a member of the Law Society of BC, and significant experience conducting prosecution and appeals before regulatory tribunals, or an equivalent combination of education and experience.
PROVISOS
